What happens when you get a second DWI?

When you get a second DWI it’s really similar to a first offense DWI the difference is the court is going to mandate as part of your bond that you have what’s called an ignition interlock device on your car, which is the blowing machine. The interlock is going to be on there pending the resolution of your case.

The severity between a first offense DWI and a second DWI is a first offense with a blood alcohol level under a .15 is a class B misdemeanor, which is one-step above a traffic ticket but it has a stigma of DWI. A second offense is always a class A misdemeanor. A first offense with a BAC over .15 is also a class A. The difference is the interlock device requirement. Sometimes the judges won’t do it on a first offense; where on the second offense you will have it no matter what their BAC was.
